Collision of m/v Neftegaz 67 and /w Yao Hai in 2008 - settlement of compensations to seafarers' families

Currently lawyers of the Lexcellence Law Firm are providing legal advices to the Owners of the m/v “Neftegaz 67”, National Company “Chernomorneftegaz” and their P&I Club on the issue of settlement of compensations to families of the seafarers, who died in the mentioned marine accident in 2008.

 

The brief information: 

The collision of the tug “Neftegaz 67”, which was owned by the NJSC “Chernomorneftegaz”, with the bulker “Yao Hai” (PRC) occurred on March 22, 2008 in the South China Sea (Hong Kong Strait).

The Ukrainian tug sank due to the collision and laid upside down on the ground at a depth of 37 meters. There were 25 crew members on board at the moment of the accident.  7 crew members - six of them were Ukrainians and one was the citizen of China - were on the top deck and afterwards were picked up by the rescuers on the high seas. During the first days of the ship’s survey the bodies of 3 seafarers were found by the divers. The others 15 seafarers were found after the lifting of the “Neftegaz 67” on 27th of April.

This article examines the necessity and legitimacy of the creation of a Ukrainian International Ship Register as an alternative register to the existing State Register of ships. Attention is drawn to determining the definitions registration of ships, as well as the national and international regulation governing the registration of ships, advantages for the state and shipowners. In this regard, the legal analysis was made concerning the legitimacy of such register. In addition, some proposals were made in order to save the genuine link between State and the ship, creating the mentioned register.
